Oath or Affirmation of Office
In taking the Oath or Affirmation of Office, each Councillor has made a commitment to undertake the duties of the office of councillor in the best interests of the people of Cumberland and Cumberland City Council and that they will faithfully and impartially carry out the functions, powers, authorities and discretions vested in them under the Local Government Act 1993 or any other Act to the best of their ability and judgment.
Conflicts of Interest
A councillor who has a conflict of interest in any matter with which the council is concerned, and who is present at a meeting of the council when the matter is being considered, must disclose the interest and the nature of the interest to the meeting as soon as practicable. Both the disclosure and the nature of the interest must be recorded in the minutes of the Council meeting where the conflict of interest arises. Councillors should ensure that they are familiar with Parts 4 and 5 of the Code of Conduct in relation to their obligations to declare and manage conflicts of interests.

Summary
This report details the proposed operational arrangements for Council over the 2024/25 Christmas/New Year period. Consistent with previous years, it is proposed that whilst a brief shut down period be applied in most areas, a presence consisting of staff required to ensure continuity of essential services is to be maintained.
This report also outlines the delegations proposed for the Mayor and/or General Manager during the Council recess period in January 2025 where Council does not hold a meeting.
Recommendation That Council endorse the implementation of the operational arrangements outlined in this report for the 2024/25 Christmas/New Year period and that these details be published to the community. |
Report
Consistent with Council’s adopted Code of Meeting Practice, there will be no Ordinary Meetings of Council scheduled to be held in January 2025. This means that the recess period for 2023/24 will commence following the final scheduled Council meeting for the year determined by the incoming Council, until the commencement of the first Ordinary Council Meeting in February 2025.
Proposed Christmas/New Year Operations
It is proposed that for 2024, Council operations cease from midday on Monday, 23 December 2024 in alignment with Council’s staff Christmas luncheon. The details for this event are being confirmed and all Councillors will be notified, and their attendance would be welcome.
To allow all staff to attend this event, it is proposed that Council services will cease from midday on Monday, 23 December 2024 and resume on Thursday, 2 January 2025. During this period, only staff required to continue working to deliver essential services or maintain an on-call presence will be required to work. Staff will also be directed to take annual leave on Tuesday, 24 December 2024 if they are not responsible for delivering essential services.
Whilst most services will resume operations from Thursday 2 January 2025, those staff not engaged in essential service delivery and/or maintenance will be directed to take an additional 2 days leave for the period from Thursday 2 January 2025 until Friday 3 January 2025, inclusive. These employees would then return to work on Monday 6 January 2025. Furthermore, staff with an excess leave balance, and where there is no resourcing impact on operations will be required to take additional leave from 6 January 2025 to 10 January 2025. The proposed operating arrangements for key services over this shut down period are as outlined below.
Customer Service and Afterhours
Both customer service counters will be closed during the shutdown period, however the Contact Centre will remain open for normal operating hours on the days which are not public holidays.
On the public holidays calls will be diverted through to the afterhours service. This function is considered an essential service and so would resume operations on Thursday, 2 January 2025.

Waste Collection
These services will continue as normal during this period and there will also be staff rostered on-call for cleansing and other waste related emergencies.
Development Compliance and Environmental Health teams will have staff rostered on call over the period to ensure coverage for essential services and emergency situations. Parking Patrol will have three teams available to monitor town centres and respond to urgent complaints, with the exception of Public Holidays. The Ranger team will have on-call arrangements in place on the Public Holidays and will work normal shifts on the other days.
Parks Maintenance
Staff will be rostered on to work every day except for Christmas Day, however there will also be staff rostered on-call on every day of the shutdown period to attend to emergencies and ensure continuity of essential services throughout this period.
Other Recreational Facilities
Council’s golf courses and Botanic Gardens will be closed on Christmas Day and then will resume normal operating hours.
Swimming Pools
During the period between Friday 27 December 2024 and Wednesday 1 January 2025 all aquatic centres will operate on amended hours, 9.30am to 8.00pm, with the exception of Granville Pool and Auburn Ruth Everuss Aquatic Centre which will open at 7am. All aquatic centres will be closed on Christmas Day and Boxing Day. On Christmas Eve (Tuesday 24 December 2024) and New Years Eve (Tuesday 31 December 2024) all aquatic centres will close at 5.30pm.
From Thursday, 2 January 2025 normal operating hours will resume across all operational aquatic centres.
Other Recreational Facilities
The Granville Centre will be closed on Christmas Day, Boxing Day and New Years Day and then open subject to bookings. The Holroyd Centre will be closed from 24 December to Friday, 3 January 2025.

CONCLUSION

Further details regarding the contact numbers for on-call officers will be made available to Councillors once confirmed.

Burnett Street Neighbourhood Centre Planning Proposal - Post Exhibition

Summary
At the Ordinary Council Meeting of 16 August 2023, Council resolved to progress the Burnett Street Neighbourhood Centre Planning Proposal to the Department of Planning, Housing and Infrastructure for a Gateway Determination. The Planning Proposal was submitted to the Department and a positive Gateway Determination was received.
Following the Gateway Determination, public exhibition of the Planning Proposal was undertaken between 23 April and 22 May 2024. A total of 15 submissions were received and Council officers have considered the submissions.
It is recommended that Council endorse the Planning Proposal and finalise for gazettal.
Recommendation
That Council:
1. Endorse the proposed planning controls for the Burnett Street Neighbourhood Centre, as provided in Attachment 1 and outlined in this report.
2. Once endorsed, finalise the planning proposal for the Burnett Street Neighbourhood Centre, as delegated by the Minister.
3. Delegate authority to the General Manager to make administrative, mapping and other related changes to documents associated with the Planning Proposal, consistent with the endorsed recommendations of Council.
4. Note that the Local Environmental Plan amendment will be published on the New South Wales legislation website and in the Government Gazette upon finalisation.
Report
Background
On 16 August 2023, Council resolved that a Council initiated Planning Proposal be progressed for the Burnett Street Neighbourhood Centre in Merrylands, and that the Planning Proposal be forwarded to the then Department of Planning and Environment for a Gateway Determination.
On 24 October 2023, Council received Gateway Determination contingent upon an additional flood study and overshadowing analysis, as provided as attachments to this report. Following the completion of this work, public exhibition occurred from 23 April to 22 May 2024 in accordance with the Gateway condition.
On 1 May 2024, Council adopted Cumberland Local Shops Study, that identified public domain and urban design outcomes for the Burnett Street Neighbourhood Centre, with the Planning Proposal consistent with the outcomes of the study.
Planning Proposal
The Burnett Street Planning Proposal seeks to amend the Cumberland LEP through zoning, height and density controls to reconcile minor anomalies in the context of surrounding land, as well as to support mixed use development as part of the neighbourhood centre offering services and local job opportunities. This proposal is consistent with the findings of the Local Shops Study. The proposed amendments to CLEP 2021 are shown in Table 1 and Figure 2 below.

Public Exhibition
Community Submissions
A total of 10 community submissions were received for the Planning Proposal. There was a mix of feedback from the submissions, with some in support, others against the proposal and several suggestions made on the proposal. The issues raised with the community submissions have been considered by Council officers, and a response is attached to this report.
State Agency Submissions
A total of five State agency submissions were received for the Planning Proposal. A summary of the agency submissions received is provided in Table 3 and also attached to this report.

Transport NSW raised no objection to the planning proposal and noted that the proposal is expected to generate low traffic volumes within an existing neighbourhood centre resulting in minimal traffic impacts to the surrounding local and regional transport network. |
NSW State Emergency Service (SES) |
NSW SES provided the following comments for Council’s consideration: • Conduct additional modelling to understand the full extent of flood risk for the sites from overland and mainstream flooding. • Seek advice from the Department of Climate Change, Energy, the Environment and Water (DCCEEW) regarding the impact of the proposed development on flood behaviour for adjacent and downstream areas • Consider improving evacuation route flood resilience. • Investigate and pursue options for improving stormwater management to reduce flood risk where possible. |
Biodiversity, Conservation and Science Group (BCS) |
BCS provided the following comments on the Planning Proposal: • Risks, flood constraints and potential impacts of the development on flood behaviour shall be further considered in the flood assessment. • Flooding events greater than the 1% Annual Exceedance Probability (AEP), and hazard maps for the 0.5%AEP and 0.2%AEP events to test the sensitivity of the flood constraints to the site because of rainfall increases due to climate change shall be considered. • Provide detailed mitigation measures to demonstrate that the flood risks at these sites can be managed. • Alternate flood risk management measures shall be provided. |
Heritage NSW |
Heritage NSW provided the following comments for Council’s consideration: • Investigate historic archaeology (if not undertaken) to assess the likelihood of relics and any subsequent management required under the Heritage Act 1977. • A comprehensive Aboriginal cultural heritage assessment report is recommended and should inform this planning proposal. • Council to ensure all necessary heritage assessments have been undertaken and that any impacts have been sufficiently addressed. |
Endeavour Energy |
Endeavour Energy has provided the following comments for Councils consideration: • Applicants for the proposed developments facilitated by the Planning Proposal will need to engage an Accredited Service Provider (ASP) of an appropriate level and class accreditation to assess the electricity load and the proposed method of supply for the development. • The minimum required safety clearances and controls for buildings and structures (whether temporary or permanent) and working near overhead power lines must be maintained at all times. • Avoid planting of large/deep rooted trees near electricity infrastructure. |

Following the detailed submission received from the Department of Climate Change, Energy, the Environment and Water, and NSW State Emergency Service, Council’s flood consultant was further engaged to review the submission and provide a response, as attached to this report. The response has been considered by Council officers and minor changes have been made to the Planning Proposal in accordance with feedback provided by the flood consultant.
Next Steps
Based on the submissions received and further information provided, there are no major concerns or issues in progressing the Planning Proposal. It is recommended that Council endorse the Planning Proposal and finalise for gazettal.

CONCLUSION

Summary
This report presents the Draft Minutes of the Cumberland Property Committee Extraordinary meeting held on 23 July 2024 for Council’s information.
Recommendation
That Council receive the Minutes of the Cumberland Property Committee Extraordinary meeting held on 23 July 2024, and adopt the recommendation contained therein as below:
That the Property Committee recommend that Council:
1. Accept the recommendation to award the contract to Evolve Housing Limited (ABN 161 277 137 31) in accordance with section 178 (1)(a) of the Local Government (General) Regulation 2021, for an annual management fee of $121,600 excluding GST over a term of 12 months, with the option to renew the agreement for a further 2 year period, subject to a performance assessment of the contractor that includes consultation with the tenants;
2. Ensure that all tenancies in place at the time of the contract commencement retain the same lease agreement conditions and annual rental charge for the initial 12 month contract period and any ensuing option agreement; and
3. Delegate authority to the General Manager to execute the contract and any associated documents.
