ITEM LPP022/23 – DEVELOPMENT APPLICATION FOR 95-97 DAHLIA STREET, GREYSTANES: |

The Panel resolved on Wednesday 11 October 2023 to defer the determination of the above application in order to require additional information to assist in its further consideration: (i) Details of the design, materials and location of the proposed ground level acoustic barriers, noting that there are inconsistencies between the architectural drawings, the landscape drawings and the acoustic report. For example the acoustic report identifies 2.4m perimeter barriers, whereas the landscape drawings identify 1.8m high barriers and in different locations. Details are to include views from both Dahlia Street and Alpha Road. (ii) Details of the width and form of planting proposed in front of the acoustic barrier proposed parallel to Alpha Road. (iii) The proposed form of fencing along the Dahlia Street frontage, including height not exceeding 1.5m above footpath level as well as materials, colours and associated landscaping. (iv) An updated acoustic report that verifies the acoustic performance of the revised proposal and with reference to the updated and amended plans and material. (v) Upon receipt of the above information from the Applicant, a further report from the Council officers. (vi) The further report to also include draft conditions of consent providing for: a. Left turn only for vehicles exiting the basement car park. This provision can be satisfied by way of signage; b. The basement security door to be open at all times during operating hours; c. The basement door should be constructed of clear and/or perforated materials to improve transparency and visibility; d. Pedestrian safety measures considered necessary or appropriate such as mirror(s) and/or non-tonal warning lights, associated with vehicles existing the basement and crossing the Dahlia Street footpath. The updated assessment report is to be considered by the Panel and the application is to be determined electronically. The Panel have reviewed the documentation and provide its decision below. Panel Decision: 1. That the application be approved, subject to the conditions listed in the amended Notice of Determination.
2. The Panel generally concurs with the Council Officer’s Notice of Determination subject to the addition of the following condition:
Condition 60(a) The proposed colorbond fence shall satisfy the surface density specifications outlined in Section 6.3 of the Noise Impact Assessment prepared by Rodney Stevens Acoustic Consultants (Rev 3) dated 31 October 2023.
3. Subject to the recommended conditions, the proposal will not have any unreasonable impacts on the amenity of neighbouring properties or the locality.
