Statement of Ethical Obligations

 

Oath or Affirmation of Office

In taking the Oath or Affirmation of Office, each Councillor has made a commitment to undertake the duties of the office of councillor in the best interests of the people of Cumberland and Cumberland City Council and that they will faithfully and impartially carry out the functions, powers, authorities and discretions vested in them under the Local Government Act 1993 or any other Act to the best of their ability and judgment.

 

Conflicts of Interest

A councillor who has a conflict of interest in any matter with which the council is concerned, and who is present at a meeting of the council when the matter is being considered, must disclose the interest and the nature of the interest to the meeting as soon as practicable. Both the disclosure and the nature of the interest must be recorded in the minutes of the Council meeting where the conflict of interest arises. Councillors should ensure that they are familiar with Parts 4 and 5 of the Code of Conduct in relation to their obligations to declare and manage conflicts of interests.

This report provides an update on the performance and compliance of Council’s investment portfolio for the month of February 2023.

Included in this report are the following items that highlight Council’s investment portfolio performance for February 2023.

 

Council Investments as at 28 February 2023

 

Council’s investment portfolio has a current market value of $225,484,918 and has returned 1.61% in the last 12 months.

 

The following table reflects Council’s holding in various investment categories:

 

Face Value = capital value to be repaid upon maturity

Purchase Price = capital value +/- premiums or discounts

Current Value = current market value + accrued interest

 

 

Investment Portfolio Performance

 

Council’s investment portfolio returned $415,742 for the month, being 0.19% on a marked-to-market basis versus the bank bill index benchmark’s 0.24% return. Council's managed fund investments may experience monthly volatility as financial markets undergo changes in outlook. However, such investments are expected to yield a favourable return over the long term. For the past 12 months, the investment portfolio has returned 1.61%pa versus the bank bill index benchmark’s 1.76%pa.

 

As at 28 February 2023 the cumulative interest earned was $4,047,624. This is $1,685,402 higher than the year-to-date budget of $2,362,222.

 

The performance chart below shows Council’s rolling 12 monthly return versus benchmark over the past 5 years. Each data point is the 12 month return for the stated month end:

RISK IMPLICATIONS

The investment portfolio's primary objective is the preservation of capital. The investment strategy seeks to ensure security and safeguarding of the portfolio by managing credit and interest rate risk within predetermined thresholds and parameters established in Council's Investment Policy, guided by the investment advisor. In pursuit of favourable returns, Council's investment decisions are made with due consideration of the risk and security associated with the selected investment type, while also ensuring that liquidity requirements are met.

 

 

Financial Implications

There are no financial implications for Council associated with this report.

CONCLUSION

Council hereby certifies that the investments listed within this report have been made in accordance with Section 625 of the Local Government Act 1993, Clause 212 of the Local Government (General) Regulation 2021 and Council’s Investment Policy.

Summary

This report seeks the adoption of the Conflict of Interest for Council Related Development Applications Policy, the amendments to the Cumberland Community Engagement Strategy and the amendments to the Cumberland Development Control Plan following a period of public exhibition.

 

Recommendation

That Council:

1.   Adopt the Conflict of Interest for Council Related Development Applications Policy as outlined in Attachment 1 to this report.

2.   Adopt the amendments to the Cumberland Community Engagement Strategy.

3.   Adopt the amendments to the Cumberland Development Control Plan.

 

Report

At the Ordinary Meeting of Council held on 15 February 2023, Council resolved (Min.352):

“That Council:

1.   Endorse the Draft Conflict of Interest for Council Related Development Applications Policy, as provided in Attachment 1.

2.   Endorse the amendments to the Cumberland Community Engagement Strategy, as provided in Attachment 2.

3.   Endorse the amendments to the Cumberland Development Control Plan, as provided in Attachment 3.

4.   Endorse that these documents be placed on public exhibition for 28 days, with a further report to be returned to Council.”

At the conclusion of the public exhibition period, no submissions were received by Council.

During the public exhibition period, minor amendments were made to the Environmental Planning and Assessment Regulation 2021 to clarify the application of the Policy. The amendments clarified that council-related development applications do not include development applications which include development on public roads managed by a council, such as driveway for a dwelling house across a footpath or other minor works.

As a result of this minor legislative change, the definition of council-related development has been amended in the final Policy attached to reflect this.

It is now recommended that Council adopt the Conflict of Interest for Council Related Development Applications Policy, the amendments to the Cumberland Community Engagement Strategy, and the amendments to the Cumberland Development Control Plan to ensure Council is compliant with the recent changes to the Environmental Planning and Assessment Regulation 2021.

Community Engagement

The Draft Conflict of Interest for Council Related Development Applications Policy, the amendments to the Cumberland Community Engagement Strategy, and the amendments to the Cumberland Development Control Plan were open for community consultation from Wednesday, 22 February 2023 to Wednesday, 22 March 2023. The page received 141 views with the Draft Policy downloaded 96 times. No submissions were received during the consultation period.

CONCLUSION

Cumberland Local Planning Panel - Appointment of Additional Independent Expert Members

Summary

The Local Planning Panel Direction from the Minister for Planning dated 7 December 2022 requires Council to establish a pool comprising at least fifteen (15) independent expert members and a pool comprising at least four (4) community representatives. This Direction takes effect on 24 April 2023. The purpose of this Direction is to reduce corruption risks and improve decision-making.

The Cumberland Local Planning Panel currently has thirteen (13) independent expert members and ten (10) community representatives. Council currently has sufficient number of community representatives to comply with the new Direction; however, does not currently have the minimum number of independent expert members.

Advice from the NSW Department of Planning and Environment has confirmed that the two (2) alternate chairs as selected by the NSW Minister of Planning for Cumberland City Council can also be selected as independent expert members. This approach will enable Council to comply with the Ministerial Direction to establish a pool comprising at least fifteen (15) independent expert members.

It is recommended that Council appoint the current alternate chairs of the Cumberland Local Planning Panel as independent expert members to meet the requirements of the Direction from the Minister for Planning.

 

Recommendation

That Council:

1.   Appoint Ms. Elizabeth Kinkade PSM and Mr. Michael Leavey as Independent Expert Members of the Cumberland Local Planning Panel, for a term up to 29 February 2024; and

2.   Set the Panel Remuneration in accordance with the Remuneration Determination from the Minister of Planning for Independent Expert Members. 

 

Report

On 23 February 2018, the then NSW Department of Planning and Environment contacted Council advising that the Minister of Planning requested Council to constitute its Local Planning Panel before 1 March 2018. The Panel consists of a Chair, independent expert members and community representatives.

Since this time, appointments have been made for Panel members and representatives. The most recent appointments for the positions of Chair, alternate Chairs and independent expert members was considered by Council at the meeting of 16 June 2021.  The most recent appointments for community representatives was considered by Council at the meeting of 2 March 2022.

The Local Planning Panel Direction dated 7 December 2022 from the Minister for Planning requires Council to establish a pool comprising at least fifteen (15) independent expert members and a pool comprising at least four (4) community representatives. This direction takes effect on 24 April 2023.

The Cumberland Local Planning Panel currently has thirteen (13) independent expert members and ten (10) community representatives. In accordance with the Remuneration Determination from the Minister of Planning, it is recommended that the independent expert members be remunerated in accordance with the confidential Attachment 2.

It is noted that Council complies with all other requirements of the Direction.

There are no consultation processes for Council associated with this report.

Policy Implications

The recommendations in the report are consistent with policy and legislative requirements.

Risk Implications

The appointment of additional Cumberland Local Planning Panel independent expert members is necessary to meet legislative requirements and to conduct Panel meetings. If a decision is not made by Council in March 2023, Council would not have sufficient time to make the necessary arrangements to comply with the Ministerial Direction with regard to local planning panels.

Financial Implications

Since the introduction of the Cumberland Local Planning Panel, Council has budgeted for the operation and costs associated with the Panel. The appointment of Panel members will not have any further financial implications for Council.

CONCLUSION

The purpose of this report is to appoint additional independent expert members for a term up to 29 February 2024 to comply with the Local Planning Panel Direction from the Minister for Planning dated 7 December 2022.

Recommendation

That Council:

1.       Note the items considered under delegated authority by the Cumberland Local Traffic Committee at the 1 March 2023 meeting, as provided in Attachment 1.

2.       Receive and note the minutes of the Cumberland Local Traffic Committee meeting held on 1 March 2023, as provided in Attachment 2.

 

Report

A meeting of the Cumberland Local Traffic Committee was held, and the minutes of the meeting are provided in Attachment 2. The items considered under delegated authority under Part 1 of the Terms of Reference for the Cumberland Local Traffic Committee are provided in Attachment 1.

Quarterly Progress Report on Council's Section 355 Committee and Community Advisory Committees

Summary

This report provides the Draft Minutes of the quarterly Section 355 Committee and Community Advisory Committee meetings held this Council term, convened since the last quarterly update to Council.

 

Recommendation

That Council:

1.      Receive the report noting the Draft Minutes of Council’s Section 355 and Community Advisory Committees recently convened;

2.      Approve the recommendations to Council noted in the various Committee Minutes, as summarised in the report.

 

Report

Council’s Advisory Committees conducted their quarterly from 1 February 2023. The final draft minutes of the meetings held are attached to this report. The Access Advisory and Arts Advisory Committees did not hold a meeting in February as no quorum was held. The following recommendations are made to Council:

ATSIC

The Committee recommend that Council approve the appointment of Darren SORBY as Community Representative to the Cumberland ATSIC Advisory Committee for the remainder of this Council term to September 2024, in accordance with the adopted Terms of Reference.

Access

 

Although no formal meeting was held, the Committee received three nominations for membership. These applications were reviewed by an internal panel of staff, notified to the Committee and are recommended to Council for approval.

 

It is recommended that Council approve the appointment of Zhila HASANLOO, Firas SHAWASH and Peter SIMPSON as Community Representatives to the Cumberland Access Advisory Committee for the remainder of this Council term to September 2024, in accordance with the adopted Terms of Reference.

Heritage

The Committee recommend that Council approve its additional review of its Terms of Reference to ensure consistency with other Terms of Reference documents. 

Heritage

The Heritage Committee made the following recommendation for Council to reconsider a heritage related matter:

 

This Committee is very disappointed with the outcome of the recent heritage planning proposal resolution, which saw the three HCAs removed from further protection. After the effort that the Committee put into reviewing the heritage items and the HCAs across the LGA, the removal of these HCAs with limited objection was heartbreaking. The Committee calls for the Council to reconsider for further inclusion. Considering these HCAs are complete streetscapes that represent the heritage values and historical settlement patterns of our community, it is important to protect and include these items and HCAs moving forward.”

 

It is now recommended that Council receive the report and approve the committee recommendations and appointments as outlined in the report and attached Minute documents.

Community Engagement

All applicants will be notified of Council’s decision post meeting and if supported, Council will proceed with the onboarding process of newly appointed Committee members. Committee convenors are aware of members who have not attended 3 consecutive meetings in accordance with the various adopted Terms of Reference documents for Council’s Committees.

Policy Implications

All Committees undertook their meetings in accordance with Council’s Governance Framework.

CONCLUSION

This report has been prepared to provide Council the minutes of the quarterly advisory committee meetings held in February 2023. It is now recommended that Council receive the minutes, and endorse the actions contained within the report and minutes attached.

That Council express its serious concern regarding the unkept surrounds of the northern side of Granville within the shopping centre, Parramatta Road environs and surrounding neighbourhoods. Such areas are within close proximity to the Cumberland City Council boundary and reflect poorly upon those Cumberland City neighbourhoods which reflect a much higher level of maintenance.

Summary

Pursuant to Notice, Councillors Hughes and Garrard submitted the following Motion.

 

Notice of Motion

That given the lack of passive recreational space within the Lidcombe area, particularly acknowledging the expansion of high density living, that Council approach the Federal Government to have an area of land deemed surplus to the needs of the Department of Defence within East Street, Lidcombe presently utilised by the RAAF, and that a section of this land to be dedicated to Council as a passive public open space.

 

Resourcing/FINANCIAL Implications

The approach by Council to the Federal Government on the request can be undertaken using existing resources.

General Manager Advice

The Cumberland Open Space and Recreational Strategy identifies a shortfall in open space within the Lidcombe area (south of the train station) with the benchmark used for planning purposes.

In response, Council is currently exhibiting the draft Lidcombe Town Centre Public Domain Plan, which identifies enhancements to existing public spaces in the area, as well as potential locations for the provision of additional public open space.

Pursuant to Notice, Councillors Hughes and Garrard submitted the following Motion.

 

Notice of Motion

That the General Manager report to Council highlighting the existing approved Contribution Plan and provide an option to amend the Plan so as to provide an increase in library funding so as to provide a ‘Mobile Library’ Service within Berala.

 

Resourcing/FINANCIAL Implications

If supported, a report can be prepared utilising existing staff resources.

General Manager Advice

Local infrastructure contributions are collected by Council through development to support the provision of growth infrastructure in Cumberland.  The current Cumberland Local Infrastructure Contributions Plan 2020 identifies a range of growth infrastructure projects to be partially or fully funded by contributions collected by the plan, including a line item for contributions towards new library facility floor space.  The plan identifies that these works need to be aligned with the Cumberland Community Facilities Strategy 2019-2029.

Notice of Motion

That Council:

1.   Refer resident feedback regarding significant accident and safety issues at the roundabout at the intersection of Fifth street and the Trongate, Granville to the next Traffic Committee meeting.

 

2.   Notify affected residents of any proposed actions or solutions proposed to seek their further input and feedback prior to implementation.

 

Resourcing/FINANCIAL Implications

Subject to endorsement by Council, the referral to the Cumberland Traffic Committee and any required consultation can be undertaken using existing resources.

Subject to confirmation by the Cumberland Traffic Committee and Council to proceed with the proposal, capital works associated with the proposal will be included in the 2023/24 Capital Works Program.

General Manager Advice

Issues associated with the intersection of Fifth Street and The Trongate, Granville, have previously been considered by the Cumberland Traffic Committee in November 2022.  The report and minutes are attached to this Notice.

Pursuant to Notice, Councillors Sarkis, Christou and Garrard move that  Council rescinds the resolution relating to C03/23-265 Outdoor Dining Fees during Ramadan and Easter. A copy of the resolution is shown below:

That Council: 

1.   Support local businesses by reaffirming its established position on the suspension of outdoor dining fees for the trade of food or drink immediately in front of their business premises during the Ramadan and Easter period;

2.   Undertake a retail food outlets awareness campaign and promote this position of Council through Council’s Media and Social Media channels.

Question/s:

I seek the General Manager's response to the following question:

·    Please provide confirmation as to the establishment of banners and decorations in Regents Park Ward for upcoming and then ongoing events and celebrations?

Answer/s:

 

Council has worked with Ausgrid (owner of the poles on which rods and banners are to be affixed) to obtain the necessary approvals to install the rods and banners to enable the promotion of Council events and the community celebration of festivals and cultural/religious events typically observed by our community.

 

As at the time of providing this response, all necessary approvals have been obtained from Ausgrid to install the rods and banners across the Regents Park Ward. It should be noted that there remain some poles on which rods and banners cannot be affixed, due to previously existing connections/installations or poles being unable to accommodate any further attachments.

 

Once the rods have been affixed (which is anticipated to be completed by early to mid-April), banners will be displayed at the following 53 pole locations, on a rotational cycle, consistent with the program deployed across the remainder of the LGA:

 

-      4 x Northumberland Road Auburn

-     10 x Rawson Steet Auburn

-     9 x Church Street Lidcombe

-     6 x Railway Street Lidcombe

-     12 x Amy Street Regents Park

-     8 x Woodburn Road Berala

-     4 x Campbell Street Berala

Across the Cumberland Council Local Government Area (LGA) the next program of banners will be Easter followed by Ramadan/Eid alternating with Anzac Day (both sets of flags displayed for the same period on an alternating basis).

To ensure adequate coverage of this promotion across the Regents Park Ward prior to the installation of the flags outlined above, the banner program will be supplemented for this year by a corflute program for the Easter signs.

Council has produced a set of 36 corflute signs to be placed in the following locations; this commenced from 22 March 2023: 

 

-      Lidcombe

o Corner of Joseph Street and Bridge Street

o Railway Street

o Remembrance Park walkway on Council’s light poles

-     Campbell Street Berala

-     Amy Street Regents Park

It is anticipated that all available poles in the Regents Park Ward will have banners attached to them by mid-April. Moving forward, this Ward now forms part of the standard street flag banner program which exists across the remainder of the LGA.
